1. ACCEPTANCE OF TERMS

By accessing or using the services of Contracting ReImagined ("we," "us," "our," or "Company"), you ("client," "customer," or "you") agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our services or website.

Contracting ReImagined is a sole proprietorship operating in Big Sky and Bozeman, Montana, providing residential and commercial remodeling, renovation, repair, and custom carpentry services.


2. SERVICES PROVIDED

2.1 Scope of Services

Contracting ReImagined provides the following services:

Kitchen and bathroom remodeling

Interior and exterior renovations

Custom cabinetry and millwork

Property repairs and maintenance

Commercial tenant improvements

Custom woodwork and carpentry

General contracting services (excluding plumbing and electrical work)

2.2 Service Limitations

We do not provide:

Licensed plumbing services

Licensed electrical services

Structural engineering services

Architectural design services

When such services are required, we will coordinate with licensed professionals on your behalf.

2.3 Service Area

Our primary service area includes Big Sky, Bozeman, and the surrounding Gallatin County, Montana. Projects outside this area may be considered on a case-by-case basis.


3. ESTIMATES AND CONTRACTS

3.1 Estimates

All estimates are provided free of charge and are valid for 30 days from the date of issue.

Estimates are based on information provided by the client and site visits when applicable.

Estimates are subject to change if project scope, materials, or site conditions differ from initial assessment.

An estimate is not a binding contract until a written agreement is signed by both parties.

3.2 Written Contracts

All projects require a written contract signed by both parties before work begins.

Contracts will specify scope of work, materials, timeline, payment terms, and total project cost.

Any changes to the original scope of work require a written change order signed by both parties.

3.3 Change Orders

Changes to the original project scope must be documented in writing.

Change orders may affect the project timeline and total cost.

Additional work will not commence until a change order is approved and signed.


4. PRICING AND PAYMENT

4.1 Payment Terms

Payment terms will be specified in each individual project contract.

Typical payment structure: Deposit: 30-50% upon contract signing Progress payments: As specified in contract based on project milestones Final payment: Due upon project completion and client approval

4.2 Accepted Payment Methods

We accept:

Cash

Check

Credit/Debit cards (processing fees may apply)

Bank transfers

Financing options (when available through third-party providers)

4.3 Late Payments

Payments not received within 10 days of the due date are considered late.

A late fee of 1.5% per month (18% annually) may be applied to overdue balances.

Work may be suspended if payment becomes more than 15 days overdue.

4.4 Non-Payment

Continued non-payment may result in: Project suspension or termination Placement of a mechanic's lien on the property Referral to collections Legal action to recover amounts owed


5. PROJECT TIMELINE

5.1 Estimated Completion

Project timelines are estimates based on normal working conditions.

Timelines may be affected by: Weather conditions Material availability and delivery delays Unforeseen site conditions Changes to project scope Delays in client decisions or approvals Permit processing times

5.2 Delays

We will make reasonable efforts to notify clients of any anticipated delays.

We are not liable for delays beyond our reasonable control.

Extended delays may warrant timeline adjustments documented in writing.


6. CLIENT RESPONSIBILITIES

6.1 Site Access

Client must provide reasonable access to the work site during normal business hours (Monday-Friday, 9am-5pm, unless otherwise agreed).

Client is responsible for securing pets and ensuring a safe work environment.

Client must ensure utilities (water, electricity) are available at the work site.

6.2 Permits and Approvals

Client is responsible for obtaining any required HOA approvals or permissions.

We will obtain necessary building permits unless otherwise specified in the contract.

Permit costs are typically included in the project estimate but will be itemized in the contract.

6.3 Decision Making

Client must make timely decisions regarding materials, finishes, and design choices to avoid project delays.

Failure to make timely decisions may result in schedule adjustments.

6.4 Property Protection

We will take reasonable precautions to protect client property during work.

Client should remove or protect valuable items, furniture, and personal belongings in and around the work area.


7. WARRANTIES AND GUARANTEES

7.1 Workmanship Warranty

We warrant our workmanship for a period of one (1) year from the date of project completion.

This warranty covers defects in our installation and workmanship under normal use and conditions.

7.2 Material Warranties

Materials are covered by the manufacturer's warranty.

We will provide warranty information for all materials used.

Manufacturer warranties typically range from 1-15 years depending on the product.

7.3 Warranty Exclusions

Our warranty does not cover:

Normal wear and tear

Damage from misuse, abuse, or neglect

Damage from acts of nature (floods, earthquakes, etc.)

Issues resulting from client modifications or repairs by others

Failure to perform recommended maintenance

Pre-existing conditions not addressed in the original scope of work

7.4 Warranty Claims

Warranty claims must be submitted in writing within 30 days of discovering the issue.

We will inspect and assess the claim within a reasonable timeframe.

Approved warranty work will be scheduled and completed at no additional cost to the client.


8. INSURANCE AND LIABILITY

8.1 Insurance Coverage

Contracting ReImagined carries general liability insurance for property damage and bodily injury.

We maintain workers' compensation insurance as required by Montana law.

Proof of insurance is available upon request.

8.2 Limitation of Liability

Our liability is limited to the total contract value of the specific project.

We are not liable for: Indirect, incidental, or consequential damages Lost profits or business interruption Damage to items not specified in the contract Issues arising from pre-existing conditions not disclosed to us

8.3 Client's Insurance

Clients are responsible for maintaining their own homeowner's or property insurance.

We recommend clients notify their insurance company of any major renovation work.


9. PERMITS AND COMPLIANCE

9.1 Building Permits

We will obtain necessary building permits as specified in the contract.

All work will be performed in accordance with applicable Montana building codes and regulations.

Final inspections will be scheduled and passed before project completion.

9.2 Code Compliance

We comply with all applicable federal, state, and local regulations.

If pre-existing conditions do not meet current code, bringing them up to code may require additional work and cost (to be discussed with client).


10. DISPUTE RESOLUTION

10.1 Good Faith Resolution

Both parties agree to make good faith efforts to resolve any disputes through direct communication.

10.2 Mediation

If direct resolution is unsuccessful, both parties agree to attempt mediation before pursuing legal action.

Mediation costs will be shared equally by both parties.

10.3 Arbitration

If mediation fails, disputes will be resolved through binding arbitration in Gallatin County, Montana.

Arbitration will be conducted in accordance with the rules of the American Arbitration Association.

10.4 Legal Action

Any legal action must be filed in the appropriate court in Gallatin County, Montana.

The prevailing party may be entitled to recover reasonable attorney fees and court costs.


11. TERMINATION

11.1 Client Termination

Client may terminate the contract at any time with written notice.

Upon termination, client is responsible for: Payment for all work completed to date Payment for materials ordered or purchased A cancellation fee of 10% of remaining contract value

11.2 Contractor Termination

We reserve the right to terminate the contract if: Client fails to make timely payments Client interferes with work or creates an unsafe environment Site conditions make work impossible or unsafe Client materially breaches the contract

11.3 Post-Termination

Upon termination, we will: Secure the work site Remove our equipment and materials Provide documentation of work completed Return any advance payment for work not performed (minus completed work, materials, and applicable fees)


12. INTELLECTUAL PROPERTY

12.1 Original Designs

Custom designs, plans, and specifications created by Contracting ReImagined remain our intellectual property.

Client receives a license to use designs for the specific contracted project only.

12.2 Photos and Marketing

We reserve the right to photograph completed projects for marketing and portfolio purposes.

Client may request to opt-out of photo use by providing written notice.

We will not include identifiable personal information without explicit client consent.


13. SMS/TEXT MESSAGE COMMUNICATIONS

13.1 Consent to Receive Text Messages

By providing your mobile phone number to Contracting ReImagined through our website, contact forms, phone conversations, or in-person meetings, you expressly consent to receive text messages (SMS/MMS) from us at that number.

13.2 Types of Text Messages

Text messages may include but are not limited to:

Appointment confirmations and reminders

Project updates and scheduling information

Estimate follow-ups and responses to inquiries

Payment reminders and invoicing information

Project completion notifications

Review requests and customer satisfaction surveys

Occasional marketing communications and special offers

Customer service responses

13.3 Message Frequency

Message frequency varies based on your project status and communication needs.

You may receive multiple messages per week during active projects.

Marketing messages are sent occasionally and are not frequent.

13.4 Opt-Out and Help

You have the right to opt-out of text messages at any time:

Customer service: Call (406) 500-8043 during business hours

After opting out, you will receive one final confirmation message. You will no longer receive text messages from us unless you opt back in.

Important: Opting out of marketing messages does not opt you out of essential service communications related to active projects (appointment confirmations, project updates, etc.).

13.5 Message and Data Rates

Standard message and data rates from your mobile carrier may apply.

We do not charge for text messages, but your carrier may.

Contact your mobile carrier for information about your messaging plan and rates.

13.6 Carrier Limitations

Not all mobile carriers are supported for text messaging.

Message delivery is not guaranteed and may be delayed.

We are not responsible for messages that are undelivered, delayed, or blocked by your carrier.

13.7 Device Requirements

You must have a mobile phone capable of receiving SMS/MMS messages.

A compatible mobile device and service plan are required.

We recommend keeping your contact information up to date.

13.8 Privacy and Security

Text messages sent through our system are subject to our Privacy Policy.

We do not share your mobile phone number with third parties for their marketing purposes.

Text messages may not be encrypted and should not be considered secure for highly sensitive information.

We will never request sensitive information (passwords, Social Security numbers, full credit card numbers) via text message.

13.9 Updating or Removing Your Number

We make no warranties regarding accuracy, completeness, or timeliness of website content.

14.2 Contact Forms

Information submitted through website contact forms is subject to our Privacy Policy.

Submission of a contact form does not create a contractual relationship.

By submitting a contact form with your phone number, you consent to receive text messages as described in Section 13.


15. FORCE MAJEURE

We are not liable for delays or failures to perform due to circumstances beyond our reasonable control, including but not limited to:

Natural disasters (earthquakes, floods, fires, severe weather)

Pandemics or public health emergencies

Government actions or regulations

Labor strikes or disputes

Supply chain disruptions

Acts of war or terrorism


16. SEVERABILITY

If any provision of these Terms & Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.


17. ENTIRE AGREEMENT

These Terms & Conditions, together with any signed contract for services, constitute the entire agreement between the parties and supersede all prior oral or written agreements, understandings, or representations.


18. AMENDMENTS

We reserve the right to modify these Terms & Conditions at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.

Projects under contract at the time of changes will continue under the terms in effect when the contract was signed.


19. GOVERNING LAW

These Terms & Conditions are governed by the laws of the State of Montana, without regard to conflict of law principles.
